Wind damage and the claim that follows

Uplift damage is quiet. It rarely looks like a hole, and that is exactly why claims on this coast get argued about.

What uplift actually does

Wind does not push a roof down. It pulls it up. Air moving across a roof plane drops the pressure above it, and the biggest drop sits along the edges and at the corners, which is why damage on this coast starts at a rake or an eave and works inward. The sealant strip under a shingle course lets go, the course flutters, and the next strong day it goes a little further.

From the ground the roof looks fine. Walk it and you find shingles that lift by hand when they should be stuck down, creases across a tab where it folded back and slapped down again, and granule loss in a line rather than in scattered dents. A hail claim is an argument about dents. A wind claim is an argument about whether a shingle that is no longer sealed counts as damaged, and it is a more technical conversation than most homeowners expect.

The timing problem

Because uplift damage does not leak straight away, people report it late. The house gets through the storm, gets through the next few months, and then one wet norther pushes water under the lifted course and into the decking. By then the date of loss is a question, and an insurer is entitled to ask it.

If a named storm or a hard blow goes through, it is worth having the roof looked at while the date is not in dispute, even when nothing is leaking. Photographs with a date on them cost nothing.

The three rules worth knowing before you sign

Texas does not license roofing contractors, so none of this is enforced by a trade board. It is enforced by statute and by the contract you sign.

A contractor may not pay, waive, absorb, rebate or credit your deductible. That is section 27.02 of the Business and Commerce Code, and it is a Class B misdemeanor. The deductible is yours to pay, and a quote built on the idea that you will never pay it is a quote built on a number the insurer was not told about.

A roofing contractor may not act as your public adjuster, or advertise that they adjust claims, on a property they are providing roofing services for. That is Texas Insurance Code 4102.163. A roofer can meet the adjuster, point at what they see and give you their own estimate. A roofer cannot run your claim.

If you signed at your kitchen table after somebody knocked, you have three business days to cancel, in writing, before midnight on the third day. That is chapter 601 of the Business and Commerce Code and it applies to sales over twenty five dollars solicited away from the seller's own place of business. The seller is supposed to hand you the cancellation notice with the contract. Plenty do not.

What to ask for

Ask for the estimate in writing with the scope broken out, not a single number. Ask whether the price assumes an insurance payment and what happens if the claim is denied. Ask who is pulling the permit and who is arranging the windstorm inspection, because on this coast windstorm certification is the part that gets forgotten. And ask for a physical address in the Coastal Bend.

Questions people ask

The adjuster says there is no damage. Is that the end of it?
No. You can ask the insurer for a reinspection, and you can bring your own roofing company out to walk it with the adjuster. What you cannot do is have the roofing company negotiate the claim for you, because Texas Insurance Code 4102.163 stops a roofer acting as a public adjuster on a roof they are working on.
Someone offered to cover my deductible. Is that legal?
It is not. Section 27.02 of the Texas Business and Commerce Code makes paying, waiving, absorbing or rebating a deductible a criminal offense for the contractor. It is also a fair sign of how the rest of the job will be run.
